IHC disposes of Bushra Bibi’s family meeting plea

Court says matter of medical condition of Bushra Bibi, who is in custody, falls within the executive domain


ISLAMABAD:

The Islamabad High Court (IHC) has disposed of a petition seeking court orders for family meetings and access to a personal physician for Bushra Bibi, referring the matter back to the Superintendent of Adiala Jail with directives to decide the application afresh.

Justice Arbab Muhammad Tahir issued a written judgment on the petition filed by Mubashra Khowar Maneka, the daughter of Bushra Bibi.

In its judgment, the IHC observed that if the Superintendent of Adiala Jail rejects the application, the petitioner may approach the forum of the Inspector General of Prisons. Regarding the provision of daily-use items to Bushra Bibi, the court noted that the Superintendent of Adiala Jail had previously stated that such items are being provided.

According to the judgment, the Superintendent of Adiala Jail has maintained that Bushra Bibi’s medical treatment is ongoing and that she has also been transferred to a hospital outside the prison as per requirement.

“The matter of the medical condition of Bushra Bibi, who is in custody, falls within the executive domain. If there is any objection in this regard, a forum exists under the jail rules,” the court stated.

The IHC directed that copies of the judgment be sent to the Commissioner of Islamabad and the Superintendent of Adiala Jail, and disposed of the petition.

Imaan, Hadi case

The Islamabad High Court (IHC) on Wednesday issued notices to the state on miscellaneous applications seeking an early hearing of the sentence suspension pleas of Advocate Iman Mazari and Hadi Ali Chatha in the controversial tweets case.

Justice MuhammadAzam Khan heard the applications and remarked, “We are issuing notices; we will hear the other party as well.”

Advocate Faisal Siddiqui, counsel for Imaan Mazari and Hadi Ali Chatha, requested the court to fix the case for hearing on Monday.
